Welcome to NeutralForumHarbor ("we," "us," or "our"). These Terms & Conditions ("Terms") oversee your engagement with our yacht charter services and the website at neutralforumharbor.sbs (the "Service") provided by NeutralForumHarbor.
When you reserve a charter or utilize our Service, you accept these Terms. Should you not agree with any section of these terms, then access to the Service is not permitted for you.
2. Service Overview
NeutralForumHarbor offers a range of high-end yacht chartering services, such as:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Our services are based on availability and are weather-dependent. We retain the authority to modify or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, the following is required:
- A minimum age of 18 years old
- Accurate and comprehensive information provision
- A specified deposit payment as indicated in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed only with our written acknowledgement and the receipt of payment. We hold the discretion to decline service to anyone.
3.3 Availability
Charters depend on the vessel's availability and appropriate weather conditions. We will endeavor to meet your requested dates and timings as closely as possible.
4. Payment Terms
4.1 Pricing
Fees are presented in € and include taxes where applicable unless stated otherwise. Fees are liable to alteration without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost due at the time of booking
- Remaining Payment: Due 48 hours ahead of the charter's commencement
- Incidental charges (if any): Payable after the charter's conclusion
4.3 Payment Methods
We accept a variety of payment options including major credit cards, bank transfers, and certified cheques. Payment security is ensured through encrypted processing systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full refund minus service fees
- 24-72 hours prior to departure: 50% of payment refunded
- Less than 24 hours before departure: Nonrefundable
5.2 Weather Cancellations
In case our captain deems weather conditions unsafe, we will propose to:
- Reschedule the charter to an alternative date at no further cost
- Issue a full refund if rescheduling cannot be arranged
5.3 Mechanical Issues
Should there be mechanical issues with the designated vessel, we will strive to offer an adequate replacement. If a substitute is unavailable, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers must:
- Adhere to the crew's directives
- Utilize safety gear as mandated
- Disclose any health conditions impacting their safety
- Stay within the vessel's assigned zones
6.2 Prohibited Items
There is a prohibition on the following items onboard:
- Glassware
- Illicit substances
- Weapons or firearms
- Excessive amounts of beverage (beyond reasonable for consumption)
- Pets (approval required prior)
6.3 Conduct
Passenger behavior should be respectful at all times. We reserve the right to terminate a charter early without refund if conduct endanger safety or disrupts others' experience.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is limited to the amount paid for your charter. We are not accountable for:
- Personal injuries due to passenger irresponsibility
- Loss or damage to personal items
- Indirect, consequential, or exemplary damages
- Postponements due to weather or events outside our control
7.2 Insurance Coverage
Our operations and vessels are insured with comprehensive marine insurance. Passengers bear the responsibility for their own travel and personal insurance coverage.
7.3 Assumption of Risk
Engaging in our charter services signifies that you comprehend and assume the inherent risks involved with marine activities. You are accountable for your security and health.
8. Modifications and Itinerary Changes
We hold the right to change itineraries, paths, or schedules due to weather conditions, safety needs, or operational considerations. We will make every attempt to ensure similar alternative experiences.
9. Force Majeure
We bear no liability for disruptions, deferrals, or adjustments stemming from unforeseeable control outside events, which may include but not be limited to:
- Intense weather circumstances
- Natural catastrophes
- Regulatory measures
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
We process your personal data in alignment with our Privacy Policy. By engaging with our services, you consent to your data's compilation and usage as depicted in our Privacy Policy.
11. Intellectual Property
All materials on our website, such as texts, graphics, logos, and images, are safeguarded by copyright and trademark laws. You are not permitted to copy, disseminate, or make derivative works without our express consent.
12. Governing Law
The applicability of these Terms is governed by the laws of Germany. Conflicts shall be settled in the courts situated in Hamburg, Germany.
